# The death of a spouse or parent in California: what to do first, deadlines, documents, and which benefits open

*When a spouse or parent dies, Social Security can pay monthly survivors benefits to a widow, widower or unmarried child, and a one-time $255 payment. This page lists what to file first, the back-pay and filing limits each agency states, and the programs the death opens, including victim compensation and FEMA when the death came from a crime or a declared disaster.*

## What happens when a spouse or parent dies

Social Security can pay monthly survivors benefits on the worker's record to a widow or widower who is at least 60, or at least 50 with a disability, and to each unmarried child under 18 (s_lii_20cfr404_335, s_lii_20cfr404_350). The application sets how far back benefits go: up to 6 months before the month it is filed (s_lii_20cfr404_621). A widow or widower who lived with the worker can also get a one-time $255 payment (s_lii_20cfr404_390). The household that CalFresh and CalWORKs count is smaller, and a child who lost a parent may open CalWORKs (s_cdss_calworks_deprived). A death caused by a crime opens CalVCB; a death caused by a declared disaster opens FEMA funeral assistance.

Each line is the agency's own rule, with the source id it was read from on 9 October 2026.

| Program | Rule | Days | Counted from | Source |
|---|---|---|---|---|
| B026 | Survivors benefits not based on disability can be paid for up to 6 months immediately before the month the application is filed | not stated as a number | the month the application is filed (6 months back) | s_lii_20cfr404_621 |
| B026 | The $255 lump-sum death payment needs an application within 2 years of the insured's death, unless the widow(er) was already entitled to spouse benefits | not stated as a number | the date of death (2 years) | s_lii_20cfr404_392 |
| B001 | CalFresh decision no later than 30 calendar days following the date the application was filed | 30 | the date the application was filed | s_lii_7cfr273_2_30 |
| B034 | CalVCB application within seven years of the crime, or seven years after the victim knew or discovered that an injury or death occurred because of the crime | not stated as a number | the crime (7 years) | s_calvcb_time |

Only documents an official page names are listed.

- A certified copy or extract from the public record of death (death certificate) (B026; s_lii_20cfr404_720)
- Proof of identity of the person applying (B001; s_lii_7cfr273_2_identity)
- Proof of gross income that is not exempt (pay stubs, award letters) (B001; s_lii_7cfr273_2_income)

## Programs this event opens

- [[california-social-security-survivors]] (B026): A widow or widower who is at least 60, or at least 50 with a disability, and an unmarried child of the worker who is under 18 (or older with a disability that began before 22, or a full-time student) can get survivors benefits; a widow(er) who lived in the same household can get the $255 lump-sum death payment. (s_lii_20cfr404_335)
- [[california-calfresh]] (B001): CalFresh counts the people who live together and customarily buy and prepare food together; the household is re-counted without the person who died. (s_lii_7cfr273_1_household)
- [[california-calworks]] (B021): CalWORKs serves families with a child in the home deprived of parental support or care because of the absence, disability or death of either parent. (s_cdss_calworks_deprived)
- [[california-calvcb-victim-compensation]] (B034): CalVCB compensates victims of a crime involving death; family members of a person who dies (derivative victims) can be paid for funeral and burial, support loss and mental health services. (s_calvcb_death)
- [[california-fema-individuals-households]] (B064): FEMA Other Needs assistance includes necessary expenses for funeral costs caused by a declared disaster. (s_lii_44cfr206_119)

## How this page works

This page is one JSON object. The page, the Markdown and the machine copy at [/a/california-life-event-death-of-a-spouse-parent.json](https://miscsubjects.com/a/california-life-event-death-of-a-spouse-parent.json) are three views of it. Its `facts` hold the event, the first actions in order with each agency's deadline, the deadlines, the documents, the programs the event opens with the rule that opens each, and the canonical facts to collect. Every deadline and every eligibility line carries a source id; each source carries the exact words copied from the official page on 9 October 2026. A value no official page states is written UNKNOWN. The model's context is served at [/a/california-life-event-death-of-a-spouse-parent/context](https://miscsubjects.com/a/california-life-event-death-of-a-spouse-parent/context). The model has no tools and submits nothing to any agency; the agency decides. The programs and the event come from [[california-benefits-graph|the California benefits graph]]. Social Security's own pages (ssa.gov) refused requests from this build and from this Mac on 9 October 2026, so every Social Security rule here is read from the federal regulations Social Security applies.
