# Divorce, separation, or a partner moving out in California: what to do first, deadlines, documents, and which benefits open

*When a spouse or partner moves out, the household that benefits count is the one living together now. This page lists what to file first with CalFresh, CalWORKs, Medi-Cal and the housing authority, the deadlines each agency states, and the tax credits a separated parent may claim, each from the official page.*

## What happens when a spouse or partner moves out

Benefit programs count the household as it is today. CalFresh counts the people who live together and buy and prepare food together (s_lii_7cfr273_1_household); a spouse who has moved out is no longer one of them. CalWORKs serves families with a child who has lost a parent's support or care because that parent is absent (s_cdss_calworks_deprived). Medi-Cal follows the tax household (s_lii_42cfr435_603). The housing authority decides who keeps a voucher when a family breaks up (s_lii_24cfr982_315). A divorce takes at least 6 months to finish in California (s_courts_divorce); none of these programs waits for it.

## Deadlines that cost money or coverage when missed

Each line is the agency's own rule, with the source id it was read from on 9 October 2026.

| Program | Rule | Days | Counted from | Source |
|---|---|---|---|---|
| B001 | CalFresh decision no later than 30 calendar days following the date the application was filed | 30 | the date the application was filed | s_lii_7cfr273_2_30 |
| B001 | CalFresh benefits are paid from the date of application to the end of that month, so a later application loses the days before it | not stated as a number | the date of application | s_lii_7cfr273_10_from |
| B035 | Notify the housing authority promptly when a family member no longer lives in the unit | not stated as a number | the day the member moves out | s_lii_24cfr982_551 |
| B052 | A married parent filing separately can claim the federal EITC only if they lived apart from the spouse for the last 6 months of the tax year, or are legally separated under a written agreement or decree | not stated as a number | the end of the tax year (6 months) | s_irs_eitc_mfs |
| B053 | For the Child Tax Credit the child must have lived with the parent for more than half the tax year | not stated as a number | the tax year | s_irs_ctc_half_year |
| B042 | 90 days to request a state hearing on a county action; after 90 days the person must prove a good reason for asking late | 90 | the county action | s_cdss_hearing_90 |

## Documents to gather

Only documents an official page names are listed.

- Proof of identity of the person applying (B001; s_lii_7cfr273_2_identity)
- Proof of gross income that is not exempt (pay stubs, award letters) (B001; s_lii_7cfr273_2_income)
- Proof of residency at the current address (B001; s_lii_7cfr273_2_residency)

## Programs this event opens

- [[california-calfresh]] (B001): Spouses who live together must be one CalFresh household; a household is the people who live together and customarily buy and prepare food together, so a spouse who has moved out is no longer counted. (s_lii_7cfr273_1_household)
- [[california-medi-cal]] (B011): For a tax filer the Medi-Cal household is the filer and every person the filer expects to claim as a tax dependent; separate filing after a separation changes both households. (s_lii_42cfr435_603)
- [[california-calworks]] (B021): CalWORKs serves families with a child in the home who has been deprived of parental support or care because of the absence, disability or death of either parent. (s_cdss_calworks_deprived)
- [[california-housing-choice-voucher]] (B035): When a family breaks up, the housing authority decides which members continue to receive the voucher; if the break-up results from domestic violence, the victim keeps the assistance. (s_lii_24cfr982_315)
- [[california-legal-aid-eviction-benefits]] (B042): Every superior court offers help to people who do not have a lawyer and need legal information; a county action on benefits can be challenged at a state hearing. (s_courts_selfhelp)
- [[california-federal-eitc]] (B052): A married person not filing jointly can claim the EITC with a qualifying child who lived with them more than half the year, if they lived apart from the spouse for the last 6 months of the tax year or are legally separated. (s_irs_eitc_mfs)
- [[california-child-tax-credit]] (B053): The Child Tax Credit goes to the parent the qualifying child lived with for more than half the tax year. (s_irs_ctc_half_year)

## How this page works

This page is one JSON object. The page, the Markdown and the machine copy at [/a/california-life-event-divorce-separation-partner-leaves.json](https://miscsubjects.com/a/california-life-event-divorce-separation-partner-leaves.json) are three views of it. Its `facts` hold the event, the first actions in order with each agency's deadline, the deadlines, the documents, the programs the event opens with the rule that opens each, and the canonical facts to collect. Every deadline and every eligibility line carries a source id; each source carries the exact words copied from the official page on 9 October 2026. A value no official page states is written UNKNOWN. The model's context is served at [/a/california-life-event-divorce-separation-partner-leaves/context](https://miscsubjects.com/a/california-life-event-divorce-separation-partner-leaves/context). The model has no tools and submits nothing to any agency; the agency decides. The programs and the event come from [[california-benefits-graph|the California benefits graph]].
