# Leaving domestic violence in California: what to do first, deadlines, documents, and which benefits open

*A person leaving domestic violence can ask CalVCB for emergency help and relocation, ask CalWORKs to waive program requirements for good cause, keep a confidential address through Safe at Home, and file for a restraining order with no court fee. This page lists the order, the time limits each agency states, and the rule that opens each program. If you are in immediate danger, call 911.*

## What happens when someone leaves domestic violence

If you are in immediate danger, call 911. A domestic violence restraining order costs nothing to file and needs no lawyer (s_courts_dvro_fee). CalVCB covers domestic violence, pays for relocation and home security, and can approve emergency help (s_calvcb_dv_exception, s_calvcb_relocation, s_calvcb_emergency). CalWORKs can waive, for good cause and for as long as necessary, requirements that would make escaping harder (s_lii_42usc602_waive). Safe at Home gives a substitute mailing address so the new address stays private (s_sos_safeathome).

| Program | Rule | Days | Counted from | Source |
|---|---|---|---|---|
| B034 | CalVCB application within seven years of the crime, or seven years after the victim knew or discovered the injury came from the crime; victims 21 or younger have until their 28th birthday | not stated as a number | the crime (7 years) | s_calvcb_time |
| B034 | CalVCB reimbursement must be requested within three years of the service date | not stated as a number | the date of the service (3 years) | s_calvcb_bills |
| B034 | An appeal of a CalVCB denial must be filed within 45 days of the date the Board mailed the notice | 45 | the date the Board mailed the denial notice | s_calvcb_appeal |
| B021 | CalWORKs waivers for domestic violence last for so long as necessary | not stated as a number | the good cause determination | s_lii_42usc602_waive |

## Documents to gather

Only documents an official page names are listed.

- Any bills for medical, counseling or relocation costs, submitted with the CalVCB application when emergency help is requested (B034; s_calvcb_emergency)

## Programs this event opens

- [[california-calvcb-victim-compensation]] (B034): Domestic violence is a crime CalVCB covers, and the rule that victims cooperate with police and courts has exceptions for crimes involving domestic violence. (s_calvcb_dv_exception)
- [[california-calworks]] (B021): Under the federal family violence option the state screens CalWORKs applicants for domestic violence, refers them to services and waives, for good cause, program requirements such as time limits, residency and child support cooperation where compliance would make escaping harder. (s_lii_42usc602_waive)
- [[california-tcvap]] (B033): California extended benefits and services to victims of human trafficking and other serious crimes who are not yet federally certified, to the same extent as refugees; they must still meet income and resource requirements. (s_cdss_tcvap)
- [[california-legal-aid-eviction-benefits]] (B042): There is no court fee to ask for a domestic violence restraining order and no lawyer is required; court self-help centers give free help. (s_courts_dvro_fee)

## How this page works

This page is one JSON object. The page, the Markdown and the machine copy at [/a/california-life-event-fleeing-domestic-violence.json](https://miscsubjects.com/a/california-life-event-fleeing-domestic-violence.json) are three views of it. Its `facts` hold the event, the first actions in order with each agency's deadline, the deadlines, the documents, the programs the event opens with the rule that opens each, and the canonical facts to collect. Every deadline and every eligibility line carries a source id; each source carries the exact words copied from the official page on 9 October 2026. A value no official page states is written UNKNOWN. The model's context is served at [/a/california-life-event-fleeing-domestic-violence/context](https://miscsubjects.com/a/california-life-event-fleeing-domestic-violence/context). The model has no tools and submits nothing to any agency; the agency decides. The programs and the event come from [[california-benefits-graph|the California benefits graph]].
