The death of a spouse or parent in California: what to do first, deadlines, documents, and which benefits open

When a spouse or parent dies, Social Security can pay monthly survivors benefits to a widow, widower or unmarried child, and a one-time $255 payment. This page lists what to file first, the back-pay and filing limits each agency states, and the programs the death opens, including victim compensation and FEMA when the death came from a crime or a declared disaster.

What happens when a spouse or parent dies

Social Security can pay monthly survivors benefits on the worker's record to a widow or widower who is at least 60, or at least 50 with a disability, and to each unmarried child under 18 (s_lii_20cfr404_335, s_lii_20cfr404_350). The application sets how far back benefits go: up to 6 months before the month it is filed (s_lii_20cfr404_621). A widow or widower who lived with the worker can also get a one-time $255 payment (s_lii_20cfr404_390). The household that CalFresh and CalWORKs count is smaller, and a child who lost a parent may open CalWORKs (s_cdss_calworks_deprived). A death caused by a crime opens CalVCB; a death caused by a declared disaster opens FEMA funeral assistance.
