Divorce, separation, or a partner moving out in California: what to do first, deadlines, documents, and which benefits open

When a spouse or partner moves out, the household that benefits count is the one living together now. This page lists what to file first with CalFresh, CalWORKs, Medi-Cal and the housing authority, the deadlines each agency states, and the tax credits a separated parent may claim, each from the official page.

What happens when a spouse or partner moves out

Benefit programs count the household as it is today. CalFresh counts the people who live together and buy and prepare food together (s_lii_7cfr273_1_household); a spouse who has moved out is no longer one of them. CalWORKs serves families with a child who has lost a parent's support or care because that parent is absent (s_cdss_calworks_deprived). Medi-Cal follows the tax household (s_lii_42cfr435_603). The housing authority decides who keeps a voucher when a family breaks up (s_lii_24cfr982_315). A divorce takes at least 6 months to finish in California (s_courts_divorce); none of these programs waits for it.
